(a) Applicable law for campaign finance in Town elections. Colorado Constitution Article XXVIII and the Fair Campaign Practices Act shall apply to and govern all town elections except to the extent that a direct and irreconcilable conflict with the provisions of this chapter exists, in which case the provisions of this chapter shall prevail.

(b) Where and when to file campaign reports. Reports required to be filed by this article are timely if received by the town clerk not later than 11:59 p.m. on the due date. Reports may be filed electronically to be considered timely; however, originals must be filed with the town clerk within seven days of the due date. If the due date falls on a weekend or legal holiday, the report must be filed by the end of the next business day.

(c) Penalties for late filings. Failure to file required reports on or before the required due date will result in a penalty of $50 per day until the report is filed, including weekends and holidays.

(d) Municipal Campaign Contribution Limits.

(1) During an election cycle, a person or political committee, may not make aggregate contributions, including in-kind contributions, to a candidate committee in excess of $400.00 to any one candidate in any one race.

(2) No candidate committee or political committee shall accept any contributions, including contributions in-kind, from any person if that person’s contributions on behalf of the candidate have an aggregate amount or value of more than $400.00. Any contribution or portion thereof that exceeds the $400.00 limit shall be returned to the contributor within seventy-two (72) hours of receipt.

(3) Limitations imposed in this section shall not apply to contribution of a candidate’s personal funds to the candidate’s own campaign, or to any loan which is personally guaranteed by the candidate or is secured by property owned by the candidate.

(e) Allegation of campaign violation. Any candidate or registered elector of the Town who has reason to believe a campaign violation has been committed by any candidate, candidate committee, issue committee, small-scale issue committee or political committee (“respondent”) may file a written complaint in accordance with The Town Clerk Rules And Procedure For Handling Third Party Complaints Alleging Violations Of Campaign Finance Laws Relating To Municipal Elections.
