A person commits obstructing passage when he or she:

(1) Renders passage impossible, unreasonably inconvenient or unreasonably hazardous on any highway, street, sidewalk, railway, waterway, building entrance, elevator, aisle, stairway or hallway to which the public, or a substantial group of the public, has access, or any other place used for the passage of persons, vehicles or conveyances, whether alone or in concert with others; or

(2) Disobeys a reasonable request or order to move issued by a person he or she knows to be a peace officer, firefighter or person with authority to control the use of the premises, to prevent the obstruction of a highway or passageway or to maintain public safety by dispersing those gathered in dangerous proximity to a fire, riot or other hazard.

For purpose of subsection (1) above, attaching any obstructions to the perimeter fencing or railings that delineate licensed outdoor dining areas upon public sidewalks or any other public area, including, but not limited to, strollers, bicycles, the hitching of animals, or any other obstructions, shall constitute a violation of this provision.
