(a) An application for a horse-drawn carriage rides permit must be completed by an applicant on a form prescribed by the Town Clerk.

(b) The Town Clerk shall initially review applications for completeness and compliance with the provisions of this Division and, if complete and compliant, shall forward applications to the Town Manager.

(c) Applications for a horse-drawn carriage rides permit shall include the following information:

(1) The name, address and telephone number of applicant;

(2) The brand and size of the carriages to be operated, size and language of any proposed signage on the carriages, and photos of the carriages;

(3) The names and contact information of carriage operators and a brief description of the equine qualifications and experience of the proposed operators;

(4) The names of horses which will be pulling the carriages with a brief description of their training and experience;

(5) A schedule of activity, including dates of proposed rides, ride start and end times, and timing of proposed hitching and unhitching of teams which will be restricted to one (1) hour before and one (1) hour after the first and last ride respectively; provided, that all activity is completed by dusk;

(6) A specific description of the area and the streets on which the carriage is proposed to be operated, including the specific defined route and defined pick-up and drop-off locations for each horse-drawn carriage ride offered; and

(7) Such other information as the Town Manager or Town Clerk may require.

An application may be amended at any time to add operators, carriages or horses, provided all are deemed qualified under the provisions of this Division, but no multiple horse-drawn carriage rides shall operate on the same designated route at the same time.

(d) Application Review Standards.

(1) The Town Manager may refer the application among Town staff for review, comment and recommendation to include, but not to be limited to, the proposed operation plan’s compatibility with, and/or impact on:

a. Other approved activities and/or special events;

b. Pedestrian and vehicular traffic flow;

c. Public transportation; and

d. Town resources.

(2) If an application may involve impacts to private property or specific neighborhoods, the Town Manager may require that public notice be provided as to the pending application. Such notice will be at the expense of the applicant.

(e) Fees. The required application fee of forty dollars ($40.00) shall be submitted with each application. Application fees are nonrefundable. (Ord. 1466 § 3 (Exh. A), 2018)
