Any public servant has authority to carry out a court-ordered abatement, to employ such assistance and to adopt such means as are necessary to effect the abatement of the nuisance. It is the duty of any person acting on behalf of the Town in abating public nuisances to proceed with due care and without unnecessary destruction of property. However, neither the Town nor any person acting on the Town’s behalf is liable, in the absence of malice or gross negligence, for the consequences of his or her actions. (Prior code 8.04.100)
