(1) Residential Rental Affidavit. An annual affidavit is required to be filed, for each calendar year, by the Owner, property manager or the Owner’s Representative for any owner engaging in short term rentals within the Residential Zone District, as defined in the Telluride Land Use Code at Section 2-215, within the Town. The affidavit will include such information as is determined by the Town Clerk.

(2) Limited License Affidavit. An annual affidavit is required to be filed for each calendar year by the owner, Property Manager or Owner’s Representative for any owner engaging in short term rentals pursuant to a Limited License. The affidavit will include such information as is determined by the Town Clerk and must demonstrate compliance by the owner and property in question with the limitations of the Limited License, which includes that short term rental of the property in question occurs no more than a cumulative of twenty-nine (29) nights per calendar year.

(3) Self-Inspection Checklist Affidavit. An annual affidavit is required to be filed by any owner, property manager, or the Owner’s Representative, engaging in any short term rental of real property in the Town of Telluride that certifies the condition of the Short Term Rental Unit as the same relates to either basic features or certain required life/safety equipment inside the Short Term Rental Unit. The Town Clerk will determine such required information for the affidavit and the Self-Inspection Checklist Affidavit shall be required upon submission of any application and annual renewal for a Short Term Rental Unit business license. The Town may conduct, and any owner consents to, random inspections of any Short Term Rental Unit to determine that the condition of the property in question is in compliance with the Self-Inspection Checklist Affidavit on file with the Town. The owner and the Town shall endeavor to conduct such inspection no more than twenty-one (21) days from the date of notice of the inspection during a mutually convenient time when the Short Term Rental Unit is not otherwise occupied.
