For purposes of this Article, the following definitions shall apply:

Accommodations Unit means any separately owned condominium unit or condominium-hotel room as the same is defined and limited under the applicable provisions of the Telluride Land Use Code Section 6-412.G.,with one (1) or more sleeping rooms which is rented or leased for increments of less than thirty nights (1-29 nights).

Advertising includes all advertising regardless of medium, i.e., internet, print, brochures, etc. All advertising of short term rental units must include a current Town of Telluride business license number.

Business means all activities engaged in with the object of gain, benefit, advantage or profit, direct or indirect. It includes, but is not limited to, deriving compensation from activities within the Town, including the sale, supply or distribution of commodities, services or related financial transactions. Advertising of a product, service, or short term rental unit in the Town is considered doing business.

Classic License means a Town license that is available for all units defined in Section 6-1-20(1)-(3), but not a Lodging Establishment, and that has no aggregate calendar year nightly rental limitations.

Employee means any person or combination of two (2) persons working for him/herself, or another person, who is compensated for such work on an hourly, weekly, monthly or commission basis, or any combination of such means of compensation. The following shall apply:

(1) An individual who works twenty (20) hours per week or less shall be designated a part-time or half employee; thus, two (2) part-time employees shall equal one (1) employee.

(2) An individual who works more than twenty (20) hours per week shall be considered one (1) employee.

(3) An owner who works for or draws a salary from his or her business shall be designated as an employee.

Limited License means a restricted Town license for a Short Term Rental Unit that may only be rented for no more than a cumulative of twenty-nine (29) nights per calendar year.

Lodging Establishment means any hotel, motel, boardinghouse, roominghouse or lodge, as those terms are defined in the Telluride Land Use Code, owned by a single entity and having an on-site lobby. A Lodging Establishment may also include a structural complex that has engaged in a fractional ownership model or time-share model for individual units within a Lodging Establishment; in such a case if the fractionally owned unit is separately rented by the fractional unit owner it shall not require a separate Town Short Term Rental Unit license so long as the Lodging Establishment is fully licensed by the Town and provided all required tax remittances are in compliance with applicable law.

Long term license means a required license from the Town of Telluride for leasing or rental of any real property within the Town for increments in excess of six (6) months. While a Long Term License is required, there is no fee for such a license nor will any of the Town’s enforcement provisions of this Article be applicable if a property owner does not obtain a Long Term License.

Mid term license means a required license from the Town of Telluride for leasing or rental of any real property within the Town for increments in excess of twenty-nine (29) nights, but less than six (6) months. While a Mid Term License is required, there is no fee for such a license nor will any of the Town’s enforcement provisions of this Article be applicable if a property owner does not obtain a Mid Term License.

Owner Representative means a person who is on call full-time to manage a short term rental unit. The name, address, and phone number of the Owner Representative shall be listed on the business license account data on file at Town Hall.

Person means any individual, firm, partnership, joint venture, corporation, estate or trust, or any group or combination acting as a unit, in the plural as well as the singular number.

Rental House means a single family home or duplex offered for rental, rented or leased for increments of less than thirty nights (1-29 nights).

Residential License means a Town license that is available for all units defined in Section 6-1-20(1)-(3), but not a Lodging Establishment, that has nightly short term and long term rental restrictions as provided in the Telluride Land Use Code at Section 3-601.

Room rental means any sleeping room within a single-family house, duplex, or condominium which is rented or leased for increments of less than thirty (30) nights (one (1) to twenty-nine (29) nights).

Short Term Rental Regulatory Fee Program means the program implementing the Town’s annual Short Term Rental Regulatory Fee pursuant to Sec. 6-1-25 that is intended to create an equitable and balanced system to regulate the short term rental industry and the local needs of the Telluride community.

Short Term Rental Unit means an accommodations unit, unit in a lodging establishment, a rental house or a room rental which is rented or leased for increments of less than thirty (30) nights (one (1) to twenty-nine (29) nights).

Sleeping room means any area with a bed surrounded by a minimum of one (1) wall and also includes any area within a structure that is specifically rented for an individual to occupy, including but not limited to sleeping nooks or loft areas.
