(a) The Town Council shall have primary responsibility for enforcement of this Article. The Town Council shall have the power to investigate any complaint, to initiate any suit and to prosecute any action on behalf of the Town for violation of this Article or any applicable civil or criminal law concerning conduct of Town officials. Complaints which are determined to be frivolous shall be dismissed without further inquiry.

(b) The Town Manager shall have primary responsibility for enforcement of alleged violations of this Code by Town employees pursuant to the Town’s Personnel Policies.

(c) The Town Council may direct the Town Attorney to investigate or prosecute any violation of this Article.

(d) Any person who believes a violation of this Article has occurred may file a complaint directly with the Ethics Commission pursuant to Section 2-4-210 above or with the Town Council, which shall promptly investigate such complaint or refer the matter for investigation. The Town Council or Ethics Commission may thereafter take such action as it shall deem to be appropriate. Nothing in this Article shall be construed to prevent a complainant from instituting legal action through any appropriate law enforcement or judicial authority.

(e) The various provisions of this Article are cumulative and not exclusive, and shall not be construed to condition or limit any administrative, civil or criminal action or proceeding which may be instituted by the Town pursuant to this Article. (Prior code 4.18.220; Ord. 1246 §1, 2006)
