A person commits theft of rental property when he or she:

(1) Obtains the temporary use of another’s personal property, which has a worth of less than two hundred dollars ($200.00) and which is available only for hire, by means of threat or deception, or knowing that such use is without the consent of the person providing the personal property; or

(2) Having lawfully obtained possession (for temporary use) of another’s personal property, which has a worth of less two hundred dollars ($200.00) and which is available only for hire, knowingly fails, within seventy-two (72) hours after the time at which he or she agreed to return it, to reveal the whereabouts of or return the property to its owner, to the owner’s representative or to the person from whom he or she has received it.
