Whenever the Town, its agent or its agency issues permission, the Town makes no warranty or promise, express or implied, that the activity, structure or use thereby authorized is safe. The Town shall not be liable for permission issued by mistake; nor shall the Town be liable for any conduct, structure or use commenced or created in reliance on the Town’s permission; nor does the Town make any warranty, either express or implied, that any activity, construction or use is safe by virtue of the fact that no permission is required by this Code before one may undertake it.
