Sec. 1-3-150. Enabling power.

The Town Council declares that, unless explicitly provided elsewhere to the contrary, its power to enact each provision of this Code derives from:
(1) Article XX, Section 6 of the Colorado Constitution and Section 14.2 of the Town Charter, so long as this derivation of power does not render the provision invalid or unenforceable; or
(2) State enabling legislation, if and only if this derivation of power from state legislation is more effective in sustaining the validity or unenforceability of the provision of this Code than is the derivation in Paragraph (1) above. (Prior code 1.04.150)
